Otsego County Court System and OWI Cases
Two courts in Gaylord handle OWI cases. The 87-A District Court processes first and second offense OWI charges, both misdemeanors under Michigan law. Otsego County DUI Records Search Options
The best starting point is MiCOURT. This free Michigan court case search covers both the 46th Circuit and 87-A District courts. Search by name or case number to find OWI cases, charge codes, hearing dates, and outcomes. The charge codes OD (OWI), SD (Super Drunk), and FD (felony drunk driving) will appear for relevant cases. MiCOURT is updated regularly but may not include every detail in a full case file.
For a full statewide background check, use ICHAT at $10 per search. ICHAT draws from the Michigan State Police criminal history database and shows OWI convictions from all Michigan counties, not just Otsego. This is the most complete single source for statewide conviction history. Michigan law does not allow OWI convictions to be expunged, so every conviction remains on the record permanently.
The Otsego County Sheriff is at 124 S. Court Ave., Gaylord, MI 49735, phone (989) 732-3555. Their page is at otsegocountymi.gov. Arrest records from the Sheriff's Office are public records. FOIA requests go to the County Clerk Records Division at (989) 731-7285. Michigan agencies have five business days to respond to FOIA requests.
OWI Laws and Charge Types in Michigan
Michigan defines OWI based on BAC and impairment. Standard OWI applies at 0.08 percent BAC or higher. Super Drunk OWI applies at 0.17 percent and carries mandatory enhanced penalties on a first offense. Zero tolerance applies to drivers under 21, who face charges at 0.02 percent. Commercial drivers are held to 0.04 percent.
Beyond those thresholds, Michigan law includes OWVI (operating while visibly impaired) for cases where someone clearly appears impaired without a firm BAC reading, and OWPD (operating with the presence of drugs) for drug-related impairment. Each charge type has its own penalty range and court procedure. Any of these charges in Otsego County will go to the 87-A District Court if they are misdemeanors, or the 46th Circuit Court if they reach felony level.
The Michigan State Police impaired driving law page is a reliable reference for how each charge type is defined and what penalties apply at each level.
87-A District Court Hybrid DWI/Drug Court
The 87-A District Court has operated a Hybrid DWI/Drug Court since January 2008. This program serves adult OWI offenders from both the Circuit and District Courts in Otsego County. It is a structured treatment program, not a standard criminal case path. Participants go through substance use treatment, regular court check-ins, drug and alcohol testing, and close supervision over an extended period.
The goal is to address the underlying substance use issue while holding the person accountable for the OWI offense. Those who complete the program may receive reduced sentences or other benefits compared to a standard conviction. Not everyone qualifies. The court looks at the offense level, prior history, and the individual's suitability for a treatment program before admitting anyone.
If you are researching records for someone who completed the Hybrid DWI/Drug Court, some program-specific records may be held separately from the standard case file. Contact the 87-A District Court at (989) 731-0201 to ask about record access for program participants.
Sheriff Records and FOIA in Otsego County
The Otsego County Sheriff's Office handles arrests throughout the county. Most OWI stops in unincorporated parts of the county go through the Sheriff. The office is at 124 S. Court Ave. in Gaylord, and their page at otsegocountymi.gov lists office contacts and services.
Arrest records and incident reports from the Sheriff are public records under MCL 15.231. Submit FOIA requests to the County Clerk Records Division at (989) 731-7285. Written requests are required and should specify the records you need, including a date range if possible. The agency will respond within five business days and may extend by ten more days for complex requests. Fees apply for document copies and search time.

State Sources for OWI Records
State-level databases complement what is available through Otsego County's local courts and sheriff. The Michigan Department of Corrections runs OTIS, which shows state prison and parole records. Felony OWI convictions that resulted in state prison time will appear there. Most misdemeanor OWI sentences do not include state prison.
The Michigan State Police Criminal History Records unit maintains statewide conviction data. ICHAT pulls from that database. For any MSP FOIA needs, the MSP FOIA page handles requests. If an MSP trooper made an OWI arrest in Otsego County, the records go through MSP, not the county sheriff.
Driver license and suspension records are with the Secretary of State. Use the SOS driving records service to check current license status. The SOS also offers Road to Restoration clinics for those working to get a revoked license back after an OWI conviction.

Note: The 46th Circuit Court has its own website at circuit46.org with case information. Use that alongside MiCOURT when searching Otsego County felony OWI records.
