Michigan OWI Law and Delta County Cases

Michigan's OWI statute, MCL 257.625, sets the legal framework for all drunk driving cases in Delta County. The standard BAC limit is 0.08%. Drivers under 21 face a 0.02% limit. Commercial drivers are held to a 0.04% limit. A BAC of 0.17% or above triggers the High BAC charge with its enhanced penalties.

The first OWI offense is a 93-day misdemeanor. The second brings up to 1 year in jail. A third offense is a felony. Michigan has not had a time limit on prior OWI convictions since 2007. Every prior OWI counts, no matter how old it is. This is a key point for anyone with an older OWI who thinks it can no longer affect them.

Michigan's implied consent law under MCL 257.625c applies to all drivers on public roads. Any driver who refuses a chemical test faces an automatic 1-year license suspension from the Secretary of State. This administrative action is separate from the criminal case.
